Purpose of the Privacy Policy

Privacy and protection of personal information is important to us, and this policy is intended to protect personal information in accordance with applicable laws.

The purpose of the Policy is to inform users of why and how LumiVie or anyone acting on its behalf, will collect and use their personal information. It is written in clear and simple language to ensure the informed consent of users.

To ensure this protection, LumiVie will only collect, process and share personally identifiable information with the consent of the individual, unless permitted or required by law, in which case your consent will not be required.

For the purposes of this Policy, “personal information” means any information about an identifiable individual or information that can be used to identify an individual. Wherever possible, we will anonymize, pseudonymize and/or aggregate such information so that it no longer identifies an individual.

How is consent obtained?

LumiVie is committed to protecting the confidential information you provide. If you voluntarily provide personal or otherwise confidential information by phone, email or form for an application, registration or donation, we use only the information required to enable our team to respond to your message or follow up on your request. Electronic correspondence is treated with the same confidentiality measures as other written materials.

We are committed to obtaining consent prior to collecting an individual’s personal information. Consent may be express or implied and may be provided directly by the individual or their authorized representative.

We prefer to obtain express consent, whether orally, electronically or in writing. However, implied consent may be reasonably inferred from an individual’s action or inaction. For example, providing a name and address to receive a publication or a name and telephone number to obtain an answer to a question is considered implied consent to the collection of information containing personal information. In order to determine the appropriate type of consent, we consider the sensitivity of the personal information involved, the purposes for which it is being collected and the reasonable expectations of a similarly situated individual.

If we want to use personal information for a new purpose, we will describe the intended use and seek consent again.

LumiVie collects personal information from donors, clients, volunteers and employees solely for the purpose of carrying out its activities and services. 

Purposes of the data collection

The personal information collected, as well as its sensitivity, may vary depending on the context of your interactions with LumiVie. That is why it is important for us to inform you of the purposes for which we collect information and the nature of the personal information we use. 

For the distribution of information about our services: contact information, last name, first name, phone number, email address

For the execution of our services: last name, first name, address, telephone number, e-mail address, date of birth, name of deceased, date of death of the deceased. Notes to file written by the caregiver. When using our services, you will share information, opinions and beliefs that may be included in your file. Our caregivers are subject to a strict code of confidentiality and the information recorded is intended to enable the therapeutic relationship.

For the improvement, development and evaluation of our services: Contact information, demographic data and data collected in the process of providing our services. We use personal information, which we anonymize or pseudonymize, to better understand the needs of our members. 

Purpose of data treatment

LumiVie collects and uses personal information from users for the following reasons:

  • Establish contact with the user
  • Evaluate and respond to user needs
  • Building the therapeutic relationship by making notes in the patient’s file
  • Inform about our programs and services
  • Perform analyses based on anonymized demographic data

LumiVie collects and uses personal information from donors for the following reasons:

  • Issue tax receipts
  • Thank donors for their donation and support
  • Encourage donors to continue to support the organization

LumiVie collects and uses personal information from volunteers for the following reasons:

  • Enable them to carry out their volunteer work
  • Thank the volunteers for their dedication and support
  • Handle emergency or medical situations when necessary
  • Inform them of our programs and services

LumiVie collects and uses personal information from employees and contractors for the following reasons:

  • Enable them to do their work
  • Issue paychecks or monthly payments
  • Provide benefits to employees
  • Handle emergency or medical situations when necessary

Modalities of access and control of personal information

You have the right to request access to your personal information for verification purposes and to request a correction if your personal information is inaccurate. If you believe that your personal information is inaccurate or if you wish to access your personal information, you may make a request using the contact information provided at the end of this Policy.

In addition, there may be times when we are unable to provide you with access to your personal information. In this case, we will inform you of the reason why we are unable to provide you with access to your personal information. 

Sharing and reasons for sharing personal information with third parties

We do not share your personal information with companies, organizations, or individuals outside of LumiVie with the exception of our authorized vendors and partners who need access to the information for the purposes listed in this policy and within the limits of this policy, and in the following instances:

For storage on cloud servers, in which case personal information may travel through third-party jurisdictions. Please note that we only retain the services of companies that are reputable for their privacy policies.

We transfer Personal Information to other trusted companies or individuals who process it on our behalf, at our direction, in accordance with this Privacy Policy, with a level of data security at least equivalent to our own, and in compliance with any other appropriate security and privacy measures.

Use of cookies and similar technologies

When a user enters the LumiVie website or web services, a cookie is automatically created for the duration of the user session.

You can set your browser to notify you of the presence of cookies, giving you the chance to decide whether or not to accept them.

Please note that our website may contain links or references to third party sites. This policy no longer applies when you leave our website and [NAME OF ORGANIZATION] is not responsible for the collection or processing of personal information by these third parties or through these external sources.  

LumiVie prohibits its employees, suppliers, agents, partners, and any person with whom it has a business relationship from deploying or using any spyware in connection with the operation of the website.

Retention of Personal Information

LumiVie retains the data collected for different periods of time, depending on the nature of the data and its usefulness to our business. During the retention period, LumiVie takes physical and technical measures to ensure the security of data containing personal information.

The main storage locations for personal information are the corporate office, physical server and cloud server.

At the end of the retention period, which is 7 years, the personal information is destroyed. Only statistics or reports containing anonymized, non-identifiable data may be kept for long periods of time.

No personal information related to the payment is recorded or saved by LumiVie in the context of electronic payment transactions.

Reporting Privacy Incidents

A procedure is in place to identify privacy incidents, the organization will conduct an analysis of the degree of harm in relation to the incident by completing an incident log and will, if so determined, send a notification to the authorities and the victims. 

Applicable laws

This User Agreement is governed by the laws of Quebec. Any dispute relating to this agreement shall be brought before the court of the judicial district of Laval, the head office of LumiVie.
